Felony charges are the second most serious situation a defendant can face. They are second only to capital (death penalty) cases. Felonies often result in a prison sentence if one is convicted of the allegations. Such a conviction also means a person will lose their right to own a firearm, will be required to disclose the charge on job applications, and may become ineligible to work in certain professions. If you have been charged with a felony then both your freedom and your future are at stake. Bretton Barber is a felony defense attorney assisting Phoenix, Arizona defendants in such cases. Aggressive Phoenix defense attorney assisting Maricopa County residents in felony cases
Arizona felony cases are commenced when the prosecutor either seeks an indictment from the Grand Jury or when a Complaint is filed with the Court. If a Complaint is filed then a preliminary hearing is held, before a Justice of the Peace, to determine if the prosecution may proceed with felony charges in Superior Court. A defendant has the right to be present, and challenge the evidence at a preliminary hearing. At a Grand Jury proceeding, by contrast, the decision as to whether a case can proceed is a one-sided affair where only the prosecutor is present. Once permission is given for the case to proceed, an arraignment will be held at which a defendant will enter a plea of “guilty” or “not guilty.” If one requests a speedy trial then the trial must commence within 180 days of the plea if the defendant is not in custody. If you are charged with a felony then you are facing a serious situation and you require immediate legal representation.
