Arizona felony cases are commenced when the prosecutor either seeks an indictment from the Grand Jury or when a Complaint is filed with the Court. If a Complaint is filed then a preliminary hearing is held, before a Justice of the Peace, to determine if the prosecution may proceed with felony charges in Superior Court. A defendant has the right to be present, and challenge the evidence at a preliminary hearing. At a Grand Jury proceeding, by contrast, the decision as to whether a case can proceed is a one-sided affair where only the prosecutor is present.
